Delphi Successfully Represented Hummeltorp Sverige AB in the Land and Environmental Court
Delphi, through Elisabeth Werner and Caroline Appelberg, has successfully represented Hummeltorp Sverige AB in proceedings concerning a permit under the Swedish Environmental Code. The case involved an application for a permit to continue and expand its recycling operations as well as a new permit for diversion of surface water, as well as related activities in Stockholm County.
On December 12, 2023, the Land and Environmental Court granted a permit for the proposed operations. The court concluded that the activities are consistent with the general rules of consideration in Chapter 2 of the Environmental Code and the resource management provisions in Chapters 3 and 4 of the Environmental Code. Furthermore, the court found that the operations do not risk violating any environmental quality standards in an impermissible manner under Chapter 5 of the Environmental Code and are otherwise compliant with provisions relevant to permissibility under the Environmental Code.
In its assessment of permissibility, the court determined that Hummeltorp’s chosen technique of sealed cells, combined with prescribed conditions, trial regulations, and Hummeltorp’s commitments, allows the operations to be permitted despite strong opposing interests.
